Mass torts allow individuals injured by the negligence of a large corporation to pool their resources to get justice. This legal process is often possible if many people suffer similar injuries or losses due to a defective product, dangerous circumstances, or other concerns.
Our Virginia personal injury lawyers from Jenner Law, working with lawyers barred in Virginia, represent clients in a wide variety of mass torts each year. We can assess your options, determine if there is a mass tort already underway, or seek to form a mass tort with other people on your behalf. We can help you get started with a free consultation. We will answer your questions and explain how we can help. Contact us today.
Damages Recoverable by Our Virginia Mass Torts Lawyer
The goal of any civil suit is to recover fair compensation for the injured and hold the at-fault party responsible. When it comes to mass torts, we aim to achieve these two goals, too.
The types of damages recoverable in these cases are the same. Our Virginia mass tort lawyers will identify, document, and value the injuries, expenses, and losses our client incurred. Then, we demand money for those losses through a negotiated settlement or at trial.
The recoverable damages in these cases often include:
- Current and future medical care for related injuries
- Ongoing care and support needs for long-term injuries
- Physical pain, emotional suffering, and other non-economic damages
- Losses in income
- Reduced earning capacity if you can no longer work as you once did
- Property repairs and replacements
We also represent families who lost a loved one. You can trust our wrongful death team to work with your loved one’s personal representative to pursue fair compensation for your family and get justice for your lost loved one.

Understanding Mass Tort Cases Our Virginia Attorneys Handle
If we believe your case qualifies to join an ongoing mass tort or might support a class action or multidistrict litigation, we will discuss this possibility with you. We have helped many clients in Virginia navigate mass torts based on a wide range of injuries and financial harm.
A mass tort might be possible any time an organization, company, or entity acts negligently and harms many people. There is no set number necessary to qualify for a mass tort.
Some examples of mass tort cases we have handled or are currently working on include:
- Defective and dangerous drugs and medical device cases
- Tenofovir and other dangerous HIV drugs
- Injuries from recalled orthopedic hip implants
- Elmiron adverse reactions, including vision loss
- Financial institution overreach, including overdraft fee class action
- Environmental litigation

Our Virginia Mass Torts Lawyer Understands How Multidistrict Litigation Works
Mass torts allow many people who suffered injuries or harm from the same party to share evidence, research, and the financial costs of pursuing a case. They also help prevent these cases from clogging lower courts when there are hundreds or even thousands of plaintiffs. The most common type of mass tort we handle is multidistrict litigation (MDL).
MDLs form when the U.S. Panel on Multidistrict Litigation consolidates cases under a federal judge in a U.S. District Court. This judge oversees the pre-trial motions, discovery, and initial bellwether trial or trials in the case. These trials allow both sides to see how other trials will likely go, but the verdict does not apply directly to any other case.
Following bellwether trials, there are several ways these cases can be resolved. This includes:
- The defendant offers a global settlement for all agreeing plaintiffs
- The defendant offers tiered settlements to most or all plaintiffs in individual law firms
- The plaintiff takes their case back to its original jurisdiction to go to trial
While many cases we handle are MDLs, we also represent clients in class action lawsuits. These are different because they require the courts to establish a “class” of people who have suffered the same economic harm. (Class actions do not work in personal injury matters). The verdicts in this case will apply directly to members of that class, and they will likely split the payout.
